Privacy Policy


This privacy policy is intended to inform users of the website of the terms under which their personal data are collected, processed, and used, and of their rights regarding the protection of personal data in light of the applicable provisions, and more specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of personal data (the “GDPR”) and the Law of 1 August 2018 on the general data protection regime (the “Law of 1 August 2018”).


1. Data controller


In the course of operating this website (the “Website”), the real estate agency GROUPE IRIS, established and having its registered office at 6-8 Grand-rue, L-3926 Mondercange (the “Agency”), processes certain personal data of users of the Website (the “Users”).


The Agency determines the purposes and means of the data processing carried out in accordance with the GDPR and the Law of 1 August 2018. As such, the Agency is the controller of the data processing carried out.


2. Data collected and processing carried out


The Agency collects two types of personal data:


2.1. Data that the User communicates directly to the Agency


The Agency may collect data provided by the User when the User completes a contact form. If the User wishes to receive further information about a listing, the data collected will be: last name, first name, email address, and telephone number.


The User may submit a rental application file. In that case, the User will be asked to provide information concerning their personal situation and that of their household (their spouse or partner, the number of dependent children) and their professional situation (for example, their employment, income level, and so on). These data are intended to form a file for the purpose of renting a property offered by the Agency.


The User may obtain a valuation of a property intended for sale. In that context, the User will be asked to complete a form and to provide data relating to the property to be sold.


If the User decides to subscribe to the Agency’s newsletter, their email address will be collected and processed. The User may unsubscribe from the newsletter at any time by contacting the Agency or by using the link included in each newsletter.


2.2. Data collected indirectly by the Agency


In the course of browsing the Website, the Agency collects certain browsing data. This includes:


connection data, including in particular the date and time of connection, the browser type, and the IP address;

data derived from trackers: the Agency uses means that make it possible to follow the behavior of the User of the Website during their browsing, in particular through cookies (see Article 7 for further details).

3. Purposes of data processing and legal basis


The data provided by the User when completing a form are necessary in order to respond to the User’s request. They will not be used for other purposes without the User’s prior consent.


Browsing data are collected in order to analyze and measure the quality of Users’ browsing on the Website. The User may accept or refuse the collection of browsing data.


The legal basis for the data processing carried out by the Agency is the consent of the data subject (Article 6(1)(a) of the GDPR). In general, the Agency does not collect Users’ data without their prior consent.


4. Disclosure of data


In the course of its business, the Agency may disclose the data only to persons to whom the Agency outsources certain work related to the operation of the Website. Those processors are: IMMOTOP.lu.


The Agency does not transfer Users’ data to third countries within the meaning of the GDPR, that is, outside the European Union.


The Agency may be required to disclose the data in order to comply with applicable laws or at the request of an authority, or in the context of legal proceedings, for example in order to respond to complaints and/or claims, or to protect the rights or interests of the Agency or of its clients.


5. Security and retention of data


The Agency takes all precautionary measures and appropriate technical and organizational measures in order to ensure the security, integrity, and confidentiality of Users’ data and, in particular, to prevent them from being altered or damaged, or from being accessed by unauthorized third parties. However, the Agency cannot guarantee the elimination of all risk, and in particular the risks associated with the use of the Internet.


The Agency will inform the data subjects without undue delay in the event of a personal data breach that is likely to result in a high risk to their rights and freedoms, in accordance with Article 34 of the GDPR.


The Agency retains the data for no longer than is necessary for the purposes for which they are processed. Accordingly, data provided by the User when completing a form will not be retained for more than six months if no follow-up is given.


At the end of that period, the Agency will delete or anonymize the data, unless the Agency is subject to a legal obligation to retain the data for a longer period.


6. Users’ rights


Users are informed that they have the following rights:


the right of access to data: the User may at any time request access to the data concerning them, as well as a copy of those data — the Agency reserves the right to ask the User to prove their identity;

the right to request rectification of data: the User may at any time request that inaccurate or incomplete data be rectified;

the right to request erasure of data: the User may request that their data be deleted when, for example, the data are no longer necessary for the purposes for which they were collected or processed;

the right to request restriction of processing concerning them: the User may request that the Agency restrict the processing of data if, for example, the User contests the accuracy of the data concerning them or objects to the processing of the data concerning them;

the right to data portability: the User has the right to have their data transferred to another controller in a structured, commonly used, and machine-readable format, if the processing is carried out by automated means or is based on prior consent;

the right to object to the processing of data: the User may object to the processing of their data, and may withdraw their consent if the processing is based on consent, for example if the data are used for direct marketing purposes.

Users may contact the Agency to exercise their rights or to obtain further information concerning the processing of their personal data, at the following email address: contact@groupeiris.lu. The Agency will respond within a maximum period of one month.


Users are further informed that if they are not satisfied with the Agency’s response to one of their requests, or with the manner in which the Agency processes the data, they have the right to lodge a complaint with a supervisory authority (the Commission Nationale pour la Protection des Données in Luxembourg — CNPD — www.cnpd.public.lu).


7. Cookies and other trackers


7.1. Definition


The Agency uses cookies and other trackers on its Website (together, the “Cookies”). Cookies are text files that may be stored, with the User’s consent, in a dedicated space on the hard drive of the device (computer, smartphone, tablet, and so on) when the Website is used through a browser.


Cookies are transmitted by the Website’s server to the User’s browser and are intended to collect information relating to the User’s browsing and, in return, to provide the User with indications or specialized services.


7.2. User consent and management of Cookies


When connecting to the Website, a banner is displayed at the bottom of the first page. The User must either accept or customize the use of cookies (for example by refusing the use of certain Cookies) in order to be able to browse the Website.


Subject to the User’s prior consent, Cookies will be stored in the memory of the device (computer, smartphone, tablet, and so on). The information thus collected may be used by the Website or, where applicable, by a third party or a partner.

7.3. The different types of Cookies used on the Website


The Agency uses the following Cookies:


Functional cookies: these make it possible to recognize the User when they use the Website, by remembering the various choices made during their last visit to the Website. They thus make it possible to personalize, simplify, and facilitate browsing on the Website.


Analytics and audience-measurement cookies: these make it possible to record certain connection information for the purpose of analyzing and measuring traffic on the Website and of improving the presentation of the Website. These Cookies are used for the purpose of optimizing the Website.


Third-party applications — social networks: the Agency uses third-party applications that allow the User to share content, such as a property listing, on the social networks Facebook, Twitter, Google, Google+, YouTube, LinkedIn, Pinterest, and Instagram.


These social networks may identify the User when the User clicks on one of the buttons to share content via their user account, or when the User visits the Website while logged in to the user account of the social network in question.


The Agency does not control the process used by social networks to collect data relating to the User’s browsing on the Website. The User is therefore invited to consult the privacy policy of the social network used by clicking on one of the links below in order to find out what browsing data are collected and how they are used.
